The legal aftermath of the fatal accident that claimed the life of 48-year-old Shamel Lindy in Lethem on March 22nd has taken a significant step forward. Casmero Cyril Juan, a 26-year-old from Boa Vista, Brazil, who was behind the wheel during the fatal incident, has been formally charged with multiple offenses related to the accident.

Appearing before Magistrate Omadatt Chandan at the Lethem Magistrate’s Court, Juan faced a litany of charges:

  1. Causing Death by Dangerous Driving: Contrary to Section 35(1) of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  2. Driving under the Influence: Contrary to Section 39(2) of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  3. Failing to Stop after an Accident: Contrary to Section 62(1)(a) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  4. Failing to Render Assistance to an Injured Person: Contrary to Section 62(1)(C) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  5. Taking a Motor Vehicle without Owner’s Consent: Contrary to Section 108(1)(a) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  6. Driving an Unlicensed Motor Vehicle: Contrary to Section 22(1) of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  7. Operating an Uncertified Motor Vehicle: Contrary to Section 15 of the Motor Vehicles and Road Traffic Act, Chapter 51:02.
  8. Driving as an Unlicensed Driver: Contrary to Section 23(1) of the Motor Vehicle and Road Traffic Act, Chapter 51:02.
  9. Operating an Uninsured Motor Vehicle: Contrary to Section 3(1) of the Motor Vehicle Insurance (Third Party Risk) Act, Chapter 51:03.

Juan entered a plea of guilty to all charges brought against him. Consequently, he was remanded to prison pending sentencing, with the case adjourned until April 16, 2024.

The tragedy unfolded on Barrack Retreat Public Road in the Lethem’s Commercial Zone, where Lindy, a resident of Lot 48 Culvert City, was struck down while crossing the road. Lindy, who had a disability affecting her speech and hearing, was reportedly on her way to a family member’s business when the speeding vehicle, a pickup truck bearing registration number #GAD 6773, collided with her. Despite efforts by bystanders to render aid, Lindy succumbed to her injuries at the scene.

It’s reported that Juan attempted to flee the scene after the collision, but a vigilant bystander managed to apprehend him, leading to his subsequent arrest and legal proceedings.
